1. Parties and scope
These Global Terms of Service are an agreement between you and the applicable operator, publisher, or contracting entity for the product or service you use. Depending on the application, website, store listing, invoice, order page, publisher account, project page, or service, that entity may be Emagenware Inc., Mwynhad Softworks LLC, or another Emagenware-controlled publisher identified for that product. In these Terms, "Emagenware," "Company," "we," "us," and "our" mean the applicable entity.
These Terms apply to Emagenware websites, social pages, games, Minecraft mods, desktop applications, web products, APIs, internal tools, client systems, support channels, downloads, documentation, accounts, paid products, free products, and related services, unless a separate written agreement or project-specific license says otherwise.
2. Acceptance
By accessing, downloading, installing, purchasing, using, or interacting with any Emagenware product or service, you agree to these Terms. If you use a product on behalf of a company, organization, server, community, or other legal entity, you represent that you have authority to bind that entity to these Terms.
If you do not agree, do not use the product or service. Some products may require additional terms, storefront terms, open source licenses, platform rules, subscription terms, or written service agreements. If those terms conflict with these Terms for a specific product, the more specific terms control for that product.
3. Eligibility and accounts
You may use Emagenware products only if you can lawfully enter into this agreement and lawfully use the applicable product in your location. If a product requires an account, you are responsible for the accuracy of the information you provide, the security of your credentials, and activity that occurs under your account.
You may not impersonate another person, misrepresent your affiliation, use automated account creation, bypass account restrictions, or use another person's account without permission.
4. Software, mods, and license rights
Subject to these Terms and any applicable product-specific license, Emagenware grants you a limited, revocable, non-exclusive, non-transferable license to install and use the applicable software for its intended purpose. This license does not transfer ownership of any Emagenware intellectual property.
Some Emagenware projects may be open source or may include open source components. Open source components are governed by their own licenses. If a project repository, release page, mod page, or package includes a specific license, that license controls the rights granted for that project or component.
For Minecraft mods, plugins, server tools, and related files, you are responsible for using them in compliance with Minecraft, Mojang, Microsoft, server host, mod loader, distribution platform, and community rules that apply to your use.
5. Ownership
Emagenware and its licensors own all rights, title, and interest in our products, software, code, designs, trademarks, names, logos, artwork, media, documentation, websites, tools, and services, except for content owned by users, clients, open source contributors, platform providers, or third parties.
You may not copy, modify, distribute, sell, rent, lease, sublicense, reverse engineer, decompile, or attempt to extract source code from non-open-source Emagenware software except where allowed by law or by an applicable written license.
6. User content and feedback
Some products may allow you to submit content, names, files, messages, builds, bug reports, feedback, reviews, support materials, server data, project data, or other information. You keep any rights you have in content you submit, but you grant Emagenware a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, display, transmit, and use that content as needed to operate, support, protect, and improve the applicable product or service.
If you send ideas, suggestions, bug reports, feature requests, or feedback, you allow Emagenware to use them without restriction or compensation, unless a separate written agreement says otherwise. Do not send confidential information unless we have agreed in writing to receive it as confidential.
7. Acceptable use
You agree not to misuse Emagenware products or services. You may not interfere with service operations, attack infrastructure, bypass access controls, exploit security issues, distribute malware, scrape or harvest data without permission, spam, harass others, violate intellectual property rights, use our products for unlawful activity, or misrepresent Emagenware or any Emagenware product.
You may not use Emagenware products to build, distribute, or operate cheats, exploits, unauthorized automation, malicious tools, or services that harm other users, servers, communities, platforms, or networks.
8. Communities, multiplayer, and moderation
Some products may involve servers, communities, leaderboards, multiplayer features, user profiles, public pages, comments, social features, or shared content. We may moderate, remove, restrict, suspend, or terminate access to content or accounts when we believe it is necessary to protect users, comply with law, enforce these Terms, or protect the service.
We are not required to host, preserve, publish, or restore user content unless required by law or a separate written agreement.
9. Purchases, subscriptions, and refunds
Some products are free. Some products, licenses, services, or downloads may be paid. Prices, availability, taxes, billing terms, and refund rules may be shown on the applicable order page, invoice, store listing, platform, or written agreement.
If you purchase through a third-party platform, that platform's payment, refund, and account rules may apply. If you purchase directly from Emagenware, refund requests are handled under our Refund Policy and any product-specific terms. Digital products may become non-refundable once delivered, activated, downloaded, or used, except where required by law or stated otherwise in writing.
10. Client systems and internal tools
For private tools, dashboards, internal software, commissioned systems, or client work, the applicable statement of work, invoice, services agreement, license, or written contract controls the relationship between Emagenware and the client. These Terms apply only to the extent they do not conflict with that written agreement.
If you use an internal tool provided to you through your employer, label, company, server, or organization, that organization may control your access, content, account, and data. Contact that organization for questions about its own rules or data practices.
11. Third-party services
Emagenware products may link to, depend on, or integrate with third-party platforms such as storefronts, payment processors, hosting providers, mod distribution services, game platforms, analytics providers, social networks, email providers, cloud services, or open source package systems. We are not responsible for third-party services, content, outages, policies, or practices.
12. Updates, changes, and availability
We may update, patch, modify, discontinue, rename, suspend, or remove any product, feature, download, service, or account access at any time. We may need to do this for security, compatibility, business, platform, legal, technical, or community reasons.
We do not guarantee that any product or service will be available at all times, remain compatible with every device or platform, or continue to support every version, mod loader, server, operating system, dependency, or third-party service.
13. Privacy
Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information. By using Emagenware products or services, you acknowledge the Privacy Policy.
14. Disclaimers
To the maximum extent permitted by law, Emagenware products and services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. We disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, security, accuracy, and error-free operation.
We do not promise that any software, mod, tool, server, website, or service will be uninterrupted, secure, free from bugs, compatible with every environment, or suitable for your particular use case.
15. Limitation of liability
To the maximum extent permitted by law, Emagenware will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, business interruption, device damage, server damage, platform penalties, or replacement costs arising from or related to your use of Emagenware products or services.
To the maximum extent permitted by law, Emagenware's total liability for any claim related to a product or service will not exceed the amount you paid to Emagenware for that product or service in the twelve months before the event giving rise to the claim, or one hundred U.S. dollars if you paid nothing directly to Emagenware.
16. Indemnification
You agree to defend, indemnify, and hold harmless Emagenware, its owners, officers, employees, contractors, affiliates, licensors, and service providers from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from your misuse of our products or services, your violation of these Terms, your content, your server or community activity, or your violation of law or third-party rights.
17. Termination
We may suspend or terminate access to any product, account, download, service, community feature, or support channel if we believe you violated these Terms, created risk, abused the service, failed to pay amounts owed, or if continued access would create legal, technical, security, or business problems.
Sections that by their nature should survive termination will survive, including ownership, payment obligations, disclaimers, limitation of liability, indemnification, governing law, and dispute terms.
18. Governing law and disputes
Unless a product-specific agreement says otherwise, these Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Subject to applicable consumer protection laws, disputes will be brought in the state or federal courts located in New York, and you consent to jurisdiction and venue there.
If applicable law gives you mandatory rights that cannot be limited by these Terms, those rights remain in effect.
19. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Continued use of a product or service after updated Terms become effective means you accept the updated Terms.
